Elle se demande quelles sont ses devoirs et obligations en tant qu\u2019\u00e9l\u00e8ves dans le secondaire.\u00a0<\/b><\/h5>\n<h4>Que dit la loi ?<\/h4>\n<p><span style=\"font-weight: 400;\">La Belgique ne dispose pas d\u2019une loi g\u00e9n\u00e9ralisant l\u2019interdiction du port de signes distinctifs au sein des \u00e9tablissements scolaires pour les \u00e9l\u00e8ves et \u00e9tudiants. De plus, le Conseil d\u2019Etat rappelle dans sa d\u00e9cision du 21 d\u00e9cembre 2010 que l\u2019Etat belge n\u2019est pas \u00e0 proprement parler un Etat la\u00efque et que les notions de la\u00efcit\u00e9 et de neutralit\u00e9 sont distinctes.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">L\u2019Etat belge doit garantir un enseignement neutre en mati\u00e8re de convictions religieuses, philosophiques ou politiques en vertu de l\u2019article 24 de la Constitution qui dispose que \u00ab<\/span><i><span style=\"font-weight: 400;\"> L\u2019enseignement est libre (\u2026) La communaut\u00e9 assure le libre choix des parents. La communaut\u00e9 organise un enseignement qui est neutre. La neutralit\u00e9 implique notamment le respect des conceptions philosophiques, id\u00e9ologiques ou religieuses des parents et des \u00e9l\u00e8ves \u00bb<\/span><\/i><span style=\"font-weight: 400;\">. L\u2019objectif que tant \u00e0 poursuivre cet article de la Constitution est le respect de la pluralit\u00e9 d\u2019opinions des \u00e9l\u00e8ves et des parents. La libert\u00e9 des parents qu\u2019offre l\u2019article 24 a pour cons\u00e9quence que les communaut\u00e9s ont l\u2019obligation de mettre en place et d\u2019organiser un enseignement public neutre.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Il existe donc en Belgique deux r\u00e9seaux d\u2019enseignements\u00a0: l\u2019enseignement organis\u00e9 par les communaut\u00e9s, qui regroupe les \u00e9tablissements publics, et l\u2019enseignement libre qui sont des institutions priv\u00e9es, certes subventionn\u00e9es par les communaut\u00e9s, mais qui ne sont pas organis\u00e9es par ces derni\u00e8res et qui sont libre de suivre une conception religieuse, philosophique ou p\u00e9dagogique d\u00e9termin\u00e9e.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pour ce qui est de l\u2019enseignement priv\u00e9 en Belgique, les \u00e9tablissements de ce r\u00e9seau sont autonomes pour mettre en place ou non des unes restrictions de signes distinctifs, \u00e0 condition de justifier de tels restrictions en vertu des lois anti-discriminations en vigueur.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">L\u2019enseignement public communautaire est donc une comp\u00e9tence des communaut\u00e9s, en vertu de des articles 24 et 127 de la Constitution. Les communaut\u00e9s l\u00e9gif\u00e8rent de mani\u00e8re autonome, notamment sur la question de la neutralit\u00e9 dans l\u2019enseignement public communautaire. Partant, il existe deux d\u00e9crets, r\u00e9gissant la mati\u00e8re\u00a0:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Enseignement de la Communaut\u00e9 fran\u00e7aise<\/b><span style=\"font-weight: 400;\"> : c\u2019est le d\u00e9cret du 31 mars 1994 d\u00e9finissant la neutralit\u00e9 de l&#8217;enseignement de la Communaut\u00e9 fran\u00e7aise qui r\u00e9git la mati\u00e8re. Ce d\u00e9cret concerne \u00e0 la fois l\u2019enseignement public secondaire francophone et l\u2019enseignement sup\u00e9rieur. Plus pr\u00e9cis\u00e9ment, l\u2019article 3 du d\u00e9cret pr\u00e9voit que la libert\u00e9 des \u00e9l\u00e8ves et \u00e9tudiants de manifester sa religion ou ses convictions doit respecter le r\u00e8glement int\u00e9rieur de l&#8217;\u00e9tablissement.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b style=\"font-size: revert; color: initial; font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">Enseignement de la Communaut\u00e9 flamande<\/b><span style=\"font-weight: 400;\"> : En Flandre, c\u2019est le d\u00e9cret sp\u00e9cial flamand relatif \u00e0 l\u2019enseignement communautaire du 14 juillet 1998 qui est en vigueur. Ce d\u00e9cret, quant \u00e0 lui, ne concerne que l\u2019enseignement primaire et secondaire flamand et pr\u00e9voit que le Conseil de l\u2019enseignement flamand (ci-apr\u00e8s le \u00ab\u00a0Conseil du GO\u00a0! Onderwijs) est comp\u00e9tent pour mettre en place une d\u00e9claration de neutralit\u00e9 dans l\u2019enseignement communautaire.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Dans un arr\u00eat du 15 mars 2011, la Cour Constitutionnelle s\u2019est prononc\u00e9e sur la d\u00e9cision faite en 2009 du Conseil GO\u00a0!<\/span> <span style=\"font-weight: 400;\">Onderwijs g\u00e9n\u00e9ralise l\u2019interdiction de signes distinctifs dans les \u00e9coles secondaires et n\u2019a pas constat\u00e9 de violation de l\u2019article 24 de la Constitution. Elle dit en effet que le Conseil du GO\u00a0! Onderwijs est comp\u00e9tente pour mettre en place une telle interdiction g\u00e9n\u00e9ralis\u00e9e.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En 2019, le Tribunal de premi\u00e8re instance de Louvain \u00e9tablit qu\u2019une telle interdiction est constitutif d\u2019une discrimination indirecte sur base de la conviction religieuse et violerait l\u2019article 19 de la Constitution et de l\u2019article 9 de la CEDH. En effet, la Tribunal ne voyait pas en quoi, en l\u2019esp\u00e8ce, cette interdiction serait n\u00e9cessaire dans le cadre de la poursuite du but recherch\u00e9 par l\u2019article 24 de la Constitution. Un jugement similaire a \u00e9t\u00e9 rendu en 2020 par le Tribunal de premi\u00e8re instance du brabant Wallon concernant le r\u00e8glement d\u2019ordre int\u00e9rieur d\u2019une \u00e9cole secondaire.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Cependant, en mai 2024, la CEDH a confirm\u00e9 dans un arr\u00eat Mikyas et autres c. Belgique que cette d\u00e9cision du Conseil GO\u00a0! Onderwijs n\u2019est pas constitutif d\u2019une violation de l\u2019article 9 de la CEDH. En effet la Cour rappelle que, dans une soci\u00e9t\u00e9 d\u00e9mocratique, il est parfois n\u00e9cessaire de limiter la libert\u00e9 religieuse. La Cour argumente que, pour respecter le pluralisme et la libert\u00e9 d\u2019autrui poursuivis par l\u2019article 24, la manifestation par les \u00e9l\u00e8ves de leurs croyances religieuses \u00e0 l\u2019int\u00e9rieur des \u00e9tablissements scolaires publics ne doit pas constituer en un acte ostentatoire pouvant cr\u00e9er une source de pression et d\u2019exclusion envers les autres \u00e9l\u00e8ves. C\u2019est \u00e0 travers cette argument que la Cour \u00e9tablit le caract\u00e8re n\u00e9cessaire et l\u00e9gitime de la d\u00e9cision du Conseil du GO\u00a0! Onderwijs.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En r\u00e9sum\u00e9, les \u00e9tablissements primaires et secondaires ont la possibilit\u00e9 d\u2019interdire le port de signes distinctifs afin de poursuivre l\u2019objectif de l\u2019article 24 de la Constitution, pour autant qu\u2019une telle interdiction soit, dans les faits, n\u00e9cessaire et non-constitutif d\u2019une discrimination indirecte Cette interdiction doit \u00eatre pr\u00e9vu par ailleurs explicitement dans le r\u00e8glement de l\u2019\u00e9cole. Aussi, une telle interdiction risque d\u2019engendrer une discrimination sur base de la conviction religieuse si elle ne respecte pas les conditions pr\u00e9vues par la jurisprudence. <\/span><\/p>\n<h4>Que dois-je faire ?<\/h4>\n<ul>\n<li aria-level=\"1\"><span style=\"font-weight: 400;\">Consulter le r\u00e8glement d\u2019ordre int\u00e9rieur de l\u2019\u00e9tablissement scolaire en question.\u00a0<\/span><\/li>\n<li aria-level=\"1\"><span style=\"font-weight: 400;\">Communiquer \u00e0 la direction la l\u00e9gislation en vigueur ainsi que les d\u00e9cisions de justice pertinentes.<\/span><\/li>\n<li aria-level=\"1\"><span style=\"font-weight: 400;\">Entamer une proc\u00e9dure en interne pour r\u00e9gler \u00e0 l\u2019amiable d\u2019\u00e9ventuelles conflits entre l\u2019\u00e9tudiant et l\u2019\u00e9tablissement.<\/span><\/li>\n<li aria-level=\"1\"><span style=\"font-weight: 400;\">Saisir UNIA pour signaler une discrimination.<\/span><\/li>\n<li aria-level=\"1\"><span style=\"font-weight: 400;\">Saisir le service juridique d\u2019Equitas qui vous accompagnera \u00e0 chacune des \u00e9tapes.<\/span><\/li>\n<\/ul>\n<h4>R\u00c9F\u00c9RENCES APPLICABLES<\/h4>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Article 9 de la Convention europ\u00e9enne des droits de l\u2019Homme.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Articles 19, 24 et 127 de la Constitution belge.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Loi du 10 mai 2007 tendant \u00e0 lutter contre certaines formes de discriminations.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">D\u00e9cret du 31 mars 1994 d\u00e9finissant la neutralit\u00e9 de l&#8217;enseignement de la Communaut\u00e9 fran\u00e7aise.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">D\u00e9cret sp\u00e9cial relatif \u00e0 l\u2019enseignement communautaire n\u00e9erlandophone du 14 juillet 1998.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">D\u00e9cret de la Communaut\u00e9 fran\u00e7aise du 12 d\u00e9cembre 2008 relatif \u00e0 la lutte contre certaines formes de discrimination.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">CEDH 16 mai 2024, <\/span><span style=\"font-weight: 400;\">Mikyas et autres c.
