As Ramadan approaches, she would like to take a few days off to rest and enjoy the last days of the month as well as Eid. She wonders if she has the right to take these days off and if the legislation provides for specific leave for religious holidays.  <\/b><\/h5>\n<h4>What does the law say?<\/h4>\n<p><span style=\"font-weight: 400;\">The law of January 4, 1974, and its implementing decree of April 18, 1974, establish ten (10) official public holidays in Belgium:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">1<\/span><span style=\"font-weight: 400;\">st<\/span><span style=\"font-weight: 400;\"> January (New Year&#8217;s Day); <\/span> <\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Easter Monday;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">1<\/span><span style=\"font-weight: 400;\">st<\/span><span style=\"font-weight: 400;\"> May (Labor Day); <\/span> <\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ascension Day; <\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Whit Monday; <\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">July 21 (National Day);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">August 15 (Assumption); <\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">1<\/span><span style=\"font-weight: 400;\">st<\/span><span style=\"font-weight: 400;\"> November (All Saints&#8217; Day);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">November 11 (Armistice Day);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">December 25 (Christmas). <\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The Royal Decree of November 19, 1998, concerning leave and absences granted to members of State administration staff refers to this law regarding the application of these public holidays for public sector workers. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">There are no official public holidays in Belgium for other religious celebrations, including Eid or Ramadan. Despite several legislative proposals aimed at establishing floating holidays, these initiatives have not been successful. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, Muslim workers wishing to be absent for religious reasons have several options:<\/span><\/p>\n<h5><b>1. Take legal leave: <\/b><\/h5>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Private sector<\/b><span style=\"font-weight: 400;\"> : According to Article 3 of the coordinated law on annual leave for salaried workers, employees are entitled to at least twenty-four (24) days of leave per year, depending on their professional activity in the previous year. It is also possible that additional days of leave for circumstances such as religious holidays are provided by employers through collective labor agreements, work regulations, or employment contracts.  <\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Public sector<\/b><span style=\"font-weight: 400;\">: The law of December 14, 2000, also provides a minimum of twenty-four (24) days of annual leave for public servants.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h5><b>2. Negotiate unpaid leave:<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">In the absence of remaining leave days, the employer may grant unpaid leave or a modification of work schedules.<\/span><\/p>\n<\/p>\n<h4><b>Protection against discrimination:<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">Article 7 of the law of May 10, 2007, aimed at combating certain forms of discrimination prohibits an employer from refusing leave solely because of an employee&#8217;s religious beliefs. This would indeed constitute direct discrimination. (See practical guide)  <\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, the employer may refuse a request for legal or unpaid leave for objective and legitimate reasons, such as:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A lack of staff during this period;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A need for service continuity (especially in the public sector);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The specificity of certain tasks; <\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The proper functioning of the structure.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">It is therefore preferable to anticipate and discuss it as early as possible with the employer in order to best organize the distribution of leave.<\/span><\/p>\n<\/p>\n<h4>What should I do?<\/h4>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Communicate the current legislation to the employer.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Contact the union delegation, the Committee for Prevention and Protection at Work (CPPT) or any other worker representative in your company in case of disputes. <\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Contact UNIA to report discrimination.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Contact the CCIE&#8217;s legal department, which will support you at every stage.<\/span><\/li>\n<\/ul>\n<h4><b>Applicable references: <\/b><\/h4>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Article 19 of the Belgian Constitution<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Article 9 of the ECHR<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Law of May 10, 2007 to combat certain forms of discrimination.  <\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Law of January 4, 1974, on public holidays<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Coordinated law of June 28, 1971, on annual leave for salaried workers<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Law of December 14, 2000, establishing certain aspects of the organization of working time in the public sector<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Royal Decree of November 19, 1998, on leave and absences granted to members of State administration staff<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Royal Decree determining the general implementing procedures for the law of January 4, 1974, on public holidays<\/span><\/li>\n<\/ul>\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Cam\u00e9lia, a Muslim, is a mathematics teacher in a secondary school located in the Brussels Region.
