Elle est en bonne sant\u00e9 et ne rencontre aucune difficult\u00e9 particuli\u00e8re \u00e0 l&#8217;\u00e9cole. Lors d&#8217;un cours d&#8217;\u00e9ducation physique, sa professeure s&#8217;adresse \u00e0 la classe et affirme que tous les \u00e9l\u00e8ves musulmans ne doivent pas je\u00fbner pendant son cours. Une enseignante a-t-elle le droit d&#8217;interdire \u00e0 une \u00e9l\u00e8ve de je\u00fbner durant le mois de Ramadan ?\u00a0<\/b><\/h5>\n<h4>Que dit la loi ?<\/h4>\n<p><span style=\"font-weight: 400;\">L\u2019article 14 de la Convention internationale des droits de l\u2019enfant, ratifi\u00e9e par la Belgique le 16 d\u00e9cembre 1991, dispose que\u00a0:<\/span><\/p>\n<blockquote>\n<p><span style=\"font-weight: 400;\">\u00ab\u00a0<\/span><b><i>Les \u00c9tats parties respectent le droit de l\u2019enfant \u00e0 la libert\u00e9 de pens\u00e9e, de conscience et de religion<\/i><\/b><i><span style=\"font-weight: 400;\">. Les \u00c9tats parties respectent le droit et le devoir des parents ou, le cas \u00e9ch\u00e9ant, des repr\u00e9sentants l\u00e9gaux de l\u2019enfant, de guider celui-ci dans l\u2019exercice du droit susmentionn\u00e9 d\u2019une mani\u00e8re qui corresponde au d\u00e9veloppement de ses capacit\u00e9s. <\/span><\/i><b><i>La libert\u00e9 de manifester sa religion ou ses convictions ne peut \u00eatre soumise qu\u2019aux seules restrictions qui sont prescrites par la loi et qui sont n\u00e9cessaires pour pr\u00e9server la s\u00fbret\u00e9 publique, l\u2019ordre public, la sant\u00e9 et la moralit\u00e9 publiques, ou les libert\u00e9s et droits fondamentaux d\u2019autrui.<\/i><\/b><span style=\"font-weight: 400;\">\u00a0\u00bb<\/span><\/p>\n<\/blockquote>\n<p><span style=\"font-weight: 400;\">Aussi, l\u2019article 30 de cette m\u00eame convention pr\u00e9voit \u00e9galement que les \u00c9tats parties\u00a0:<\/span><\/p>\n<blockquote>\n<p><span style=\"font-weight: 400;\">\u00ab\u00a0<\/span><i><span style=\"font-weight: 400;\">O\u00f9 <\/span><\/i><b><i>il existe des minorit\u00e9s <\/i><\/b><i><span style=\"font-weight: 400;\">ethniques, <\/span><\/i><b><i>religieuses<\/i><\/b><i><span style=\"font-weight: 400;\"> ou linguistiques ou des personnes d\u2019origine autochtone, <\/span><\/i><b><i>un enfant autochtone ou appartenant \u00e0 une de ces minorit\u00e9s ne peut \u00eatre priv\u00e9 du droit d\u2019avoir sa propre vie culturelle, de professer et de pratiquer sa propre religion <\/i><\/b><i><span style=\"font-weight: 400;\">ou d\u2019employer sa propre langue en commun avec les autres membres de son groupe\u00a0\u00bb<\/span><\/i><span style=\"font-weight: 400;\">.<\/span><\/p>\n<\/blockquote>\n<p><span style=\"font-weight: 400;\">A cela s\u2019ajoute\u00a0:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">L\u2019article 9 de la Convention europ\u00e9enne des droits de l\u2019Homme (CEDH), qui prot\u00e8ge la libert\u00e9 de pens\u00e9e, de conscience et de religion.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">L\u2019article 19 de la Constitution belge sur la garantie de la libert\u00e9 de culte pour tous.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Les dispositions communautaires en mati\u00e8re de libert\u00e9 religieuse pour les enfants dans l\u2019enseignement notamment, l\u2019article 1.7.4-8 du Code de l\u2019enseignement francophone, qui pr\u00e9voit que les \u00e9l\u00e8ves sont libres d\u2019exercer leur libert\u00e9 religieuse.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Par cons\u00e9quent, au vu de ces textes, une enseignante ne peut ne peut pas interdire \u00e0 une \u00e9l\u00e8ve de je\u00fbner, sauf si une restriction sp\u00e9cifique est pr\u00e9vue par la loi et justifi\u00e9e par des imp\u00e9ratifs comme la protection de la sant\u00e9 publique ou de l\u2019ordre public.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">L\u2019article 14 de la Convention internationale des droits de l\u2019enfant pr\u00e9voit que la libert\u00e9 de culte peut \u00eatre limit\u00e9e pour des motifs l\u00e9gitimes, \u00e0 condition que ces restrictions soient express\u00e9ment pr\u00e9vues par la loi. Or, en Belgique, aucune l\u00e9gislation n\u2019interdit aux \u00e9l\u00e8ves de je\u00fbner \u00e0 l\u2019\u00e9cole primaire ou secondaire.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Par cons\u00e9quent, un membre du personnel ou un \u00e9tablissement scolaire ne peut imposer une interdiction g\u00e9n\u00e9rale du je\u00fbne aux \u00e9l\u00e8ves mineurs sans risquer d\u2019entraver leur libert\u00e9 de culte, sans motif l\u00e9gitime. En outre, avant l\u2019interdiction pour motif l\u00e9gitime, il est essentiel de trouver un \u00e9quilibre entre celui-ci et le respect des croyances religieuses des \u00e9l\u00e8ves.<\/span><\/p>\n<h4>Que dois-je faire ?<\/h4>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Encourager un dialogue avec les enseignants, les \u00e9l\u00e8ves et leurs parents.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Solliciter l\u2019organisation de sessions d\u2019information pour sensibiliser les enseignants sur les bonnes pratiques afin de garantir la libert\u00e9 religieuse des \u00e9l\u00e8ves.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Communiquer \u00e0 la direction la l\u00e9gislation en vigueur.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Saisir UNIA en cas de discrimination av\u00e9r\u00e9e.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Saisir le <a href=\"https:\/\/ccieurope.org\/signalement\/\">service juridique du CCIE<\/a> qui vous accompagnera \u00e0 chacune des \u00e9tapes.<\/span><\/li>\n<\/ul>\n<h4><b>R\u00e9f\u00e9rences applicables :\u00a0<\/b><\/h4>\n<ul>\n<li aria-level=\"1\"><span style=\"font-weight: 400;\">Articles 14 et 30 de la<\/span> <span style=\"font-weight: 400;\">Convention internationale des droits de l\u2019enfant<\/span><\/li>\n<li aria-level=\"1\"><span style=\"font-weight: 400;\">Article 9 de la Convention europ\u00e9enne des droits de l\u2019Homme.<\/span><\/li>\n<li aria-level=\"1\"><span style=\"font-weight: 400;\">Articles 19 et 127 de la Constitution belge.<\/span><\/li>\n<li aria-level=\"1\"><span style=\"font-weight: 400;\">L\u2019article 1.7.4-8 du Code de l\u2019enseignement francophone. <\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Nadia, 14 years old, attends a public school in the Brussels Region.
