Listen blev udarbejdet i k\u00f8lvandet p\u00e5 TV 2-dokumentaren &#8220;Moskeerne bag sl\u00f8ret&#8221;. Den blev f\u00f8rste gang offentliggjort den 2. maj 2017 (2) og omfatter i dag 15 forkyndere, som alle er muslimer (3). Der har kun v\u00e6ret en ikke-muslim p\u00e5 listen siden dens oprettelse.     (4)<\/p>\n\n<p>Listen administreres af Udl\u00e6ndingestyrelsen og fremstilles som et v\u00e6rn mod religi\u00f8se forkyndere, der angiveligt s\u00f8ger at underminere danske love og v\u00e6rdier eller veya underst\u00f8tte parallelelle retsopfattelser (5). Dav\u00e6rende udl\u00e6ndinge- og integrationsminister Inger St\u00f8jberg<em>fremf\u00f8rte<\/em>, at:<em>&#8220;Religi\u00f8se hadpr\u00e6dikanter er ondskabens fangarme, og vi skal forhindre dem i at komme til Danmark og fors\u00f8ge at manipulere andre med deres ekstreme, rabiate holdninger (6)<\/em>.&#8221; <\/p>\n\n<p>Efter de g\u00e6ldende regler kan en religi\u00f8s forkynder st\u00e5 p\u00e5 listen i to \u00e5r ad gangen med mulighed forl\u00e6ngelse, men ogs\u00e5 med mulighed for at blive fjernet ved en l\u00f8bende vurdering (7).<\/p>\n\n<p><strong>Retssikkerhedsproblemer<\/strong><\/p>\n\n<p>Udl\u00e6ndingelovens \u00a7 29 c (8), Udl\u00e6ndingestyrelsen&#8217;e, en udl\u00e6ndinges adf\u00e6rd udg\u00f8r en trussel mod den offentlige orden, men bestemmelsen opstiller ingen pr\u00e6cise kriterier og overlader afg\u00f8relsen til et sk\u00f8n. Hukuki a\u00e7\u0131dan bu durum sorunludur, zira kesin kriterler kabul edilmeli ve uygulanmal\u0131d\u0131r. Kriterlerin tan\u0131mlanmas\u0131 ya da a\u00e7\u0131kl\u0131\u011fa kavu\u015fturulmamas\u0131 halinde reel kontrol umulabilir. Dermed kan beslutninger ikl\u00e6des et sk\u00e6r af sikkerhed, men tr\u00e6ffes i praksis uden dokumenteret bel\u00e6g. Dette underst\u00f8ttes af to islamforskere Niels Valdemar Vinding fra K\u00f8benhavns Universitet og Martin Thomas Riexinger fra Aarhus Universitet (9). De siger begge, <em>at <\/em>udv\u00e6lgelsen virker ulogisk og uigennemskuelig: <em>&#8220;Jeg kan ikke se, at der er en stringent argumentation bag, hvordan den her list er sat sammen&#8221;, <\/em>siger Niels Valdemar Vinding til Kristeligt Dagblad (10).<\/p>\n\n<p>Institut for Menneskerettigheder har desuden i en h\u00f8ring kritiseret bestemmelsen for at kr\u00e6nke grundl\u00e6ggende menneskerettigheder som ytrings- og religionsfrihed. De p\u00e5peger, at indgrebene can v\u00e6re uproportionale, and at lovforslaget er s\u00e5 bredt og uklart defineret, at det giver anledning til alvorlige retssikkerhedsm\u00e6ssige problemer.  (11)<\/p>\n\n<p>Herudover er det v\u00e6sentligt at fremh\u00e6ve, at Udl\u00e6ndingestyrelsen som administrativ myndighed (12) befinder sig i en potentiel interessekonflikt. Denne dobbeltrolle, hvor styrelsen b\u00e5de administrerer listen og tr\u00e6ffer afg\u00f8relser om optagelse, kan rejse tvivl om, hvorvidt vurderingerne kan siges at v\u00e6re objektive. Set i et retssikkerhedsperspektiv kan dette sv\u00e6kke kravene om uafh\u00e6ngighed og gennemsigtighed.  <\/p>\n\n<p><strong>Opm\u00e6rksomhedslisten<\/strong><\/p>\n\n<p>Som supplement til en sanktionsliste oprettes en opm\u00e6rksomhedsliste, der indeholder personer, som ikke opfylder kriterierne for optagelse p\u00e5 en sanktionsliste, men som myndighederne alligevel b\u00f8r v\u00e6re s\u00e6rligt opm\u00e6rksomme p\u00e5 under sagsbehandlingen (13). Opm\u00e6rksomhedslisten kan medf\u00f8re vilk\u00e5rlig overv\u00e5gning og stigmatisering og dermed skabe en uklar gr\u00e6nse mellem berettiget control og un\u00f8dvendig registrering. <\/p>\n\n<p><strong>Sistematik diskriminasyon<\/strong><\/p>\n\n<p>Sammenfattende, netop disse personer er udvalgt i\u00e7in sistematik n\u00e6gtes indrejse, uden at der gives indsigt i, imamer en eksklusiv registrering som dinlemek i\u015flevini g\u00f6r\u00fcr. Manglen p\u00e5 klare kriterier eller dokumenteret begrundelse skaber uforudsigelighed og en systematisk sk\u00e6vhed, hvor \u00e9n religi\u00f8s gruppe rammes uforholdsm\u00e6ssigt h\u00e5rdt. N\u00e5r et s\u00e5kaldt sikkerhedsv\u00e6rkt\u00f8j bruges uden gennemsigtighed, flyttes balancen v\u00e6k fra frihed og retssikkerhed.
